Claims Administration Management

The settlement management services that JNL offers to enable class action settlement proceeds to be distributed as efficiently as possible after the completion of an accurately and efficiently conducted claims administration include the following:

Coordinating with the claims administrator approved by the Court (the “Claims Administrator” concerning the establishment of protocols, processes and timetables, including those related to nominees, late claims, placeholder claims and class action claims consultants (the “AdministrationProcess”) to comply with the following goals (the “Administration Goals”), as interpreted under Rule 23, as amended effective December 1, 2018:

The Administration Process undertaken in connection with the subject settlement(s) (the “Settlements”) is consistent with standards and practices commonly applied in the administrations of class action settlements that, when considering the nature of relevant characteristics, such as, but not limited to, the amount of the recovery, the volume and composition of putative class members, the subject matter of the action, and the claims asserted in the action (the “Relevant Characteristics”), that are similar to the Settlements;

The Administration Process, considering the Relevant Characteristics, is likely to treat fairly and reasonably in relation to one another those members of the class or of the settlement class that submitted proofs of claim to participate in the Settlements (“Claimants”) taken as a whole; and

The Administration Process is consistent with the plan of allocation and the plan of distribution, as applicable, approved by the court overseeing the action (the “Court”).

Monitoring the Claims Administrator’s conduct of the Administration Process solely for the purpose of evaluating whether taken as a whole, it complied with the Administration Goals.

Coordinating with the Claims Administrator in connection with its preparation of submissions to the Court, including submissions concerning the conduct and results of the Administration Process.

Preparing a submission to the Court concerning the results of JNL’s engagement, including whether, based on JNL’s performance of the foregoing settlement management services, the Administration Process, taken as a whole, complied with the Administration Goals.
